Trump’s State Department Moves to Require Parents to Prove Citizenship for Child Passports

The State Department has drafted new guidance that could significantly change how parents apply for passports for their children, according to reporting published September 1. Under the proposal, parents would be required to provide documentation proving their own U.S. citizenship or lawful immigration status before a child’s passport could be issued.

Currently, parents generally establish their relationship to the child, provide identification, and complete the required citizenship attestations. The proposed policy would add documentation such as a valid U.S. passport or birth certificate for citizens, while lawful immigrants could be required to provide records such as a green card or I-94 arrival document.

The reported change follows an August executive order from President Donald Trump targeting so-called “birth tourism,” in which foreign nationals travel to the United States specifically to give birth. Administration officials argue that tighter passport procedures would strengthen enforcement of existing citizenship rules and prevent abuse of the system.

The proposal is already drawing legal scrutiny. Attorneys challenging the administration’s broader citizenship policies have raised concerns that new documentation requirements could create difficulties for ordinary families, including Americans born abroad, adoptive parents, and families involving surrogacy arrangements.

Critics also warn that parents who cannot easily locate old birth certificates or immigration documents could face delays when obtaining passports for their children.

The State Department has not yet announced when the guidance would take effect, and the proposal could still be revised before becoming final.

For now, families applying for passports should continue following existing State Department requirements. But if the new rule is adopted, parents seeking a child’s first passport could soon face an additional step: proving their own citizenship or lawful immigration status before the application can move forward.
