The Survey Flags Exposed a Much Bigger Problem Than the Missing Fence

The inspector measured the unfinished deck twice, then compared his numbers with the survey markers. Whitney’s contractor had designed the new structure using the old fence line as the property boundary. Because my fence had actually stood six inches inside my yard, part of the expanded deck framing crossed the required setback and several new footings had been installed where the approved permit did not allow them. The city issued a stop-work order until corrected plans were submitted. Suddenly, Whitney’s “just a fence” had become a renovation delay involving her contractor, surveyor, permit office, and thousands of dollars in work that might need to be removed and rebuilt.

That afternoon, Whitney appeared at my door without her iced coffee or her smile. She offered to replace the fence if I would tell the city everything had been a misunderstanding. I explained that I had never asked the city to punish her. I had simply provided an accurate survey after she removed property that belonged entirely to me. Her contractor’s insurance eventually handled the damaged fence, and a new cedar barrier was installed precisely inside my boundary. Whitney had to redesign part of her deck to comply with the city’s setback requirements.

Weeks later, the construction finally resumed.

Her new deck turned out beautifully.

So did my new fence.

The difference was that this time, everybody involved knew exactly where her property ended and mine began.
