Judge William Sullivan formally declared the mistrial Friday after the panel repeatedly reported that it remained hopelessly deadlocked.<\/p>\n<p>The dispute centered on an apparent 11-1 split. Defense attorney Kevin Reddington argued that a single juror was refusing to properly apply the court\u2019s instructions concerning reasonable doubt and asked Sullivan to remove that juror. Prosecutors opposed the request, saying disagreement during deliberations did not establish bias or misconduct. The defense also wanted to determine whether jurors had unanimously resolved any individual charges, which could potentially affect what prosecutors may retry. The emergency petition was ultimately denied, clearing the way for Sullivan to end the trial without a verdict.<\/p>\n<p>Clancy, 36, is charged in the January 2023 deaths of her three children\u2014Cora, Dawson and Callan. Contrary to some reports describing the deaths as drownings, prosecutors say the children were strangled. Clancy does not dispute causing their deaths but argues she was not criminally responsible because she was experiencing postpartum psychosis. Prosecutors contend she understood her actions and acted deliberately.<\/p>\n<p>The mistrial does not end the case. Prosecutors can seek another trial, negotiate a resolution or reconsider how to proceed.
